OB1Net Terms and Conditions/Acceptable Use Policy Terms and Conditions This document contains the terms and conditions of OB1Net internet access
and the acceptable use provisions of this service. Use of the internet
access service Service OB1Net provides high-speed internet access through a shared T-1 line.
Service Rates and Fees The monthly service rate is $30.00 Setup and Equipment There is a one-time setup and installation fee for OB1Net service. This
fee is $120 and is for the setup of one computer or wireless router. This
fee is non-refundable. Billing OB1Net internet access service is prepaid. Check Payment Option
Customer choosing the check option will be billed
quarterly by email at $90.00.
Payments are due on the first of February, May, August, and November. Checks should be made to OB1Net. The first quarter of new accounts will be pro-rated at $30 for one month and $60 for two months. Quarterly payments are refundable for unused months only and are issued after equipment return. Credit Card Payment Option
Customer choosing automatic credit card debit will
be billed monthly. Payments are due on the first day of the month. Credit
card payments are non-refundable. Customer is responsible for providing
correct credit card information and for updating any changes to the credit
card account. All billing mistakes should be reported to OB1Net within
60 days of the disputed charge.
Default Customer account is in default on the 16th of the month or the 16th of the quarter. Service will be disconnected for default of payment. Service interrupted for non-payment will be reconnected at a service charge of $15.00. Service Contract OB1Net does not require a length of service contract. Customer may cancel service at any time. There are no cancellation fees. Service cancellation requested after the regular billing date will be billed for the whole month of service. Customer must contact OB1Net at 831-3295 or email at customerservice@ob1net.net for service cancellation. Service will be terminated at the next billing date. OB1Net equipment should be returned within 14 days after service termination. Technical Support Technical support from OB1Net is limited to loss of internet connectivity
arising from problems of the OB1Net system or customer's OB1Net supplied
hardware. OB1Net technical support is not responsible for customer's computer
hardware, Service trouble may be reported during regular business hours by phoning
OB1Net at 831-3295. Regular business hours are Monday through Friday between
9am and 5pm. After hours, messages may be left on the OB1Net answering
machine or customers may access the contact page on the OB1Net website
to report a problem. Calls and emails will be answered the next business
day. All onsite service calls are by appointment only and must be made
in advance by phone or email. Warranty Disclaimer OB1NET INTERNET ACCESS SERVICE IS PROVIDED ON AN "AS IS" BASIS AND CUSTOMER USES THE SERVICE AT CUSTOMER'S OWN RISK. OB1NET GIVES NO WARRANTY EXPRESSED OR IMPLIED FOR THE SERVICE PROVIDED INCLUDING WITHOUT LIMITATION, WARRANTY OF MERCHANTABILITY AND WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. OB1NET DOES NOT WARRANT THAT SERVICES WILL PERFORM AT A PARTICULAR SPEED, OR WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. Limitations of Liability Customer agrees to indemnify and hold harmless OB1Net from any claims resulting from customer use or disruption of the service. OB1Net will not be responsible for direct, indirect, incidental, special or consequential damages incurred while using the OB1Net service to either customer or business of customer. This includes but is not limited to loss of income, loss of data, delays and interruption to service caused by natural disasters, man-made disasters, government degree, electrical system surges and failures, communication line failure, or unauthorized entry into customer computer, computer network or data. Acceptable Use Policy The Acceptable Use Policy contains the rules for using the OB1Net service. Use of the service constitutes acceptance and customer agreement to abide by all OB1Net policies. Reselling of Service Customers may not resell or distribute OB1Net services in whole or in part. Service Interference Customer will not intentionally interfere with service to other users, hosts or the network. This includes but is not limited to network flooding, denial of service attacks, and disruption of connection between network and other customer accounts. Unsolicited Bulk Email Customer is prohibited from using the OB1Net network, servers, or services to transmit Unsolicited Bulk Email (UBE). UBE is defined as advertising or solicitations for products or services sent to multiple recipients who have not agreed to receive such communications. OB1Net also prohibits the transmission of fraudulent electronic communications including but not limited to chain letters, pyramid schemes or emails with forged headers. File Sharing Software Customers using file-sharing applications must disallow computer from
being used Malicious Software Customer is prohibited from using the OB1Net network, servers or services from transmitting malicious software. This includes but is not limited to "viruses, Trojan-horse programs, worms or logic bombs". Network and Personal Security Customer is prohibited from tampering with or interfering with OB1Network security. Customer shall not attempt to crack passwords or security encryption codes, log into an unauthorized account or attempt to access data that does not have public access. Customer should keep all passwords secret and secure. Lawful Use Customer is solely responsible for any activities to or from customer account. OB1Net services are to be used for lawful purposes only. OB1Net services are not to be used in any manner that infringe on the rights of any third party, including but not limited to intellectual property rights, copyright infringement. Bandwidth Usage In order to provide a high quality and low cost internet access service to all OB1Net customers, OB1Net must limit bandwidth usage of customers. Bandwidth usage will be measured as a percentage of network utilization per unit of time. Customer will be notified by OB1Net of excessive usage and will be asked to voluntarily reduce their usage. Service Monitoring OB1Net has the right but not the obligation to monitor service in order to enforce bandwidth usage limitations and other acceptable use provisions, to properly operate the service and to protect the OB1Network service. Privacy Statement OB1Net will not disclose or sell any of customer's personal information collected for account registration to any third party. Personal information includes name, address, phone number, email address, or credit card information. OB1Net will not monitor or disclose information on customer internet usage or other private data. Customer acknowledges the right of OB1Net to monitor customer use and disclose information concerning customer's account when required by local, state or federal law enforcement authorities or by any court order. Use Restriction and Service Termination OB1Net reserves the right to restrict customer bandwidth usage if customer exceeds bandwidth usage and does not voluntarily comply with bandwidth usage reduction. OB1Net reserves the right to disconnect customer service if customer is in violation of any provision of this Acceptable Use Policy. Arbitration and Choice of Venue This contract and all transactions between OB1Net and the customer shall be governed by and constructed in accordance with the laws of the state of California. Disputes and claims relating to this agreement or to OB1Net's service shall be settled in San Francisco California. All disputes or claims shall be settled by mediation or binding arbitration. Binding arbitration shall be considered total and finalmendments to Terms and Conditions/Acceptable Use Policy Admendments to Terms and Conditions/Acceptable Use Policy OB1Net may amend the Terms and Conditions and the Acceptable Use Policy at any time. Service agreement changes will be posted on the OB1Net website. Customers will be informed of changes by email and will have ten days to discontinue service if customer does not want to accept the new terms. Continued use of the service constitutes acceptance of all new provisions. |
